Product listings and availability may change. Adding an item to your cart does not reserve it. If an ordered item becomes unavailable, we will contact you and refund any payment collected for that item if we cannot fulfill the order.

Nothing in this section limits your statutory rights if a product is defective, not as described or otherwise does not conform to the purchase contract.

SECTION 3 - ORDERS

Placing an order constitutes an offer to purchase the products in your cart. Before submitting your order, you can review and correct the information entered at checkout. An automatic order confirmation acknowledges receipt of your order; the purchase contract is concluded when we expressly accept the order, send a shipping confirmation or dispatch the products.

We may decline or cancel an order for a legitimate reason, including unavailable stock, unsuccessful payment authorization, an obvious pricing error, an undeliverable address or suspected unauthorized activity. If we cancel an order after collecting payment, we will refund the applicable amount. We will use the contact information provided at checkout to notify you.

SECTION 4 - PRICES AND BILLING

Prices are displayed in the currency shown on the website. Prices shown to consumers include applicable value-added tax where required by law. The total price, discounts, any delivery charges and any other applicable charges will be shown at checkout before you submit your order. Standard shipping is free where stated in our Shipping Policy and at checkout.

Prices and promotions may change before an order is placed. A promotion may have additional terms, which will be displayed with the offer. The price agreed for a concluded purchase contract will not be changed arbitrarily afterward.

You agree to provide accurate payment and billing information and confirm that you are authorized to use the selected payment method. Available payment methods are those displayed at checkout. Your bank or payment provider may apply currency conversion or other charges outside our control.

For consumer orders, the risk of accidental loss or damage generally passes to you when you, or a third party you nominate other than the carrier, takes physical possession of the products. Our statutory delivery obligations and your rights if delivery is delayed or does not occur remain unaffected.

The text, branding, graphics, photographs, videos, layout and other content on the Services may be owned by staudm.shop, Shopify or their respective licensors and protected by applicable intellectual property law.

You may use the Services for lawful personal use. You may not reproduce, distribute or commercially exploit protected content without the rights holder's permission, except where the law permits it. Access to the Services does not transfer ownership of any intellectual property rights.

Our online store is powered by Shopify. Purchases made through staudm.shop are made with the seller operating staudm.shop, and we remain responsible for our obligations to you as the seller. Shopify's role in providing the platform does not limit your rights against us under your purchase contract or applicable law.

SECTION 10 - PRIVACY POLICY

Termination of website access does not remove obligations or rights relating to orders already concluded, including payment, delivery, withdrawal, refunds and statutory warranty rights. General information on the website is provided for informational purposes. We do not guarantee that access to the website will always be uninterrupted or error-free.

Products remain subject to their descriptions, any express guarantees and all mandatory statutory conformity and warranty rights. Nothing in these Terms excludes or limits those rights.

SECTION 17 - LIMITATION OF LIABILITY

We are liable without limitation where liability cannot lawfully be restricted, including for intentional misconduct, gross negligence, injury to life, body or health, fraudulent concealment, an expressly assumed guarantee, and liability under mandatory product liability law.

For ordinary negligence involving an essential contractual obligation, liability may be limited to foreseeable and typical loss where legally permitted. Nothing in these Terms limits mandatory consumer rights or remedies for defective products.

Our failure to enforce a provision at one time does not automatically waive our right to enforce it later.

These Terms, together with the policies referred to in them and the information provided for your order, govern your use of the Services and your purchase, subject to mandatory applicable law. Individual agreements expressly made with you take priority where applicable.

SECTION 21 - ASSIGNMENT

You may transfer rights under a purchase contract where applicable law permits. We may transfer our rights or obligations only where lawful and where doing so does not remove mandatory protections available to you.

SECTION 22 - GOVERNING LAW

These Terms are governed by German law, excluding the United Nations Convention on Contracts for the International Sale of Goods. If you are a consumer habitually resident in another country, this choice of law does not deprive you of mandatory protections available under the law of that country.

Mandatory rules concerning the courts in which a consumer may bring or defend a claim remain unaffected.
